Terms of Service

1. Acceptance of Terms

By accessing or using the services provided by Automated Expert™ ("Company," "we," "us," or "our"), including our website at automatedexpert.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use our services.

We reserve the right to modify these Terms at any time. Your continued use of our services after any such changes constitutes your acceptance of the new Terms.

2. Description of Services

Automated Expert™ provides business automation consulting, implementation, and management services. Our services may include, but are not limited to, CRM setup and configuration, workflow automation, lead management systems, email marketing automation, and related consulting and training.

The specific scope of services for each engagement will be defined in a separate proposal or service agreement between the Company and the client.

3. Payments and Billing

Payment terms will be specified in the applicable service agreement for each engagement. General payment terms include:

  • All fees are quoted and payable in US dollars unless otherwise specified
  • Payment is due according to the schedule outlined in your service agreement
  • Late payments may be subject to interest charges of 1.5% per month or the maximum rate permitted by law, whichever is lower
  • We reserve the right to suspend services for accounts with overdue balances exceeding 30 days
  • Refund policies, if applicable, will be outlined in your service agreement

4. Intellectual Property

Unless otherwise specified in a service agreement, upon full payment, the client will own the custom workflows, automations, and configurations built specifically for their business. However, Automated Expert™ retains ownership of any proprietary methodologies, frameworks, templates, and tools used in the delivery of services.

The Automated Expert™ name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of the Company. You may not use such marks without the prior written permission of the Company.

5. Client Responsibilities

As a client, you agree to:

  • Provide timely access to necessary accounts, tools, and information required for service delivery
  • Respond to requests for feedback, approvals, and information within a reasonable time frame
  • Ensure that any data or content you provide does not violate any third-party rights
  • Maintain the confidentiality of any login credentials we provide

6. Limitation of Liability

To the maximum extent permitted by applicable law, Automated Expert™ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

Our total liability for any claim arising out of or relating to these Terms or our services shall not exceed the total amount paid by you to us in the twelve (12) months preceding the claim.

We do not guarantee specific results, revenue increases, or business outcomes from our services. Results depend on many factors including but not limited to the client's industry, business model, implementation, and market conditions.

7. Termination

Either party may terminate a service engagement according to the terms outlined in the applicable service agreement. In the absence of specific termination provisions, either party may terminate with 30 days' written notice.

Upon termination, you will be responsible for payment of all services rendered through the termination date. We will provide reasonable assistance in transitioning your systems and data, subject to payment of any outstanding balances.

8. Confidentiality

Both parties agree to maintain the confidentiality of any proprietary or confidential information shared during the course of the engagement. This obligation survives the termination of the service agreement for a period of two (2) years.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through good-faith negotiation, and if necessary, binding arbitration in accordance with the rules of the American Arbitration Association.
